Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of the PortfolioSets website and the purchase and use of our digital products (“Products”). By accessing the site or purchasing Products, you agree to these Terms. If you do not agree, do not use the site or purchase Products.
Products and delivery
Products are digital goods (for example, source code, templates, and documents) offered as described on each product page. After successful payment through our designated checkout provider, you will receive instructions or links to download or access your files. It is your responsibility to save copies securely; we are not obligated to replace lost files indefinitely, though we may assist with technical access issues in line with our support policy.
License to Products
Subject to these Terms and payment of applicable fees, we grant you a limited license to:
- Download and use the Product materials for your personal, non-commercial job search and professional portfolio purposes;
- Modify templates and code to reflect your own projects, experience, and branding; and
- Deploy or publish portfolio work that you have customized, in accordance with any third-party open-source licenses that may apply to included dependencies (see included documentation and license files in the Product where provided).
Unless we expressly state otherwise in writing, you may not:
- Resell, sublicense, redistribute, or publicly share the Product files “as-is” as a competing template pack, course material, or marketplace listing;
- Use the Product to train machine learning models in a way that reproduces our proprietary materials at scale, where such use is not permitted by law; or
- Remove or alter proprietary notices where we require attribution, except as necessary for your personal use of customized outputs.
Intellectual property
The site and Products (except where third-party or open-source components are identified) are owned by PortfolioSets or our licensors and are protected by intellectual property laws. The limited license in these Terms does not transfer ownership.
Third-party services
Checkout, hosting, analytics, and other features may be provided by third parties. Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party services outside our reasonable control.
Disclaimers
Products are educational and practical tools to help you present your skills and prepare for hiring processes. We do not guarantee employment, interviews, salary outcomes, or results from using the Products. Hiring decisions are made by employers, and outcomes depend on many factors outside our control. The site and Products are provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by applicable law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by applicable law, PortfolioSets and its owners or affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the site or Products. Our aggregate liability for claims relating to the site or Products will not exceed the amount you paid us for the specific Product giving rise to the claim in the twelve (12) months before the claim, or fifty dollars (USD), whichever is greater, except where limitation is prohibited by law.
Indemnity
You agree to defend and indemnify PortfolioSets against claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Products, violation of these Terms, or infringement of third-party rights by content you supply or publish using the Products, except to the extent caused by our willful misconduct.
Termination
We may suspend or terminate access to the site or cease offering Products if you breach these Terms or if required for legal or operational reasons. Provisions that by their nature should survive (including license restrictions, disclaimers, liability limits, and indemnity) will survive termination.
Governing law and disputes
These Terms are governed by the laws applicable in the jurisdiction where PortfolioSets operates, without regard to conflict-of-law rules, except where consumer protection laws in your country require otherwise. Courts or tribunals in that jurisdiction may have exclusive venue for disputes, unless mandatory law gives you the right to sue in your home courts. This section should be reviewed with counsel for your actual place of business and customer base.
Changes
We may modify these Terms by posting an updated version on this page and updating the “Last updated” date. Material changes may require additional notice where required by law.
